In Canada, people living with HIV can be criminally charged for not disclosing their HIV status to sexual partners.

Criminalizing non-disclosure takes a law and order approach to a complex health and social issue – the prevention of HIV. Criminalization breeds fear, perpetuates stigma, and undermines proven HIV prevention strategies.

In Newfoundland and Labrador, the diagnosis of new HIV infections has steadily increased, but provincial testing rates remain low. Up to 26% of Canadians with HIV infection are unaware of their HIV+ status.
